Capacitor Case: Partial Settlement With Five of 22 Corporate Defendant Families

Settlements totaling $32,600,000 have been reached with Defendants Fujitsu Limited; NEC TOKIN Corporation and NEC TOKIN America, Inc. (“NEC TOKIN”); Nitsuko Electronics Corporation; Okaya Electric Industries Co., Ltd. and Okaya Electric America, Inc.; and ROHM Co., Ltd. and ROHM Semiconductor U.S.A., LLC (collectively, the “Settling Defendants”) in partial settlement of the class action lawsuit (the “Settlement Agreements”).

On January 27, 2017, the Court preliminarily approved proposed Settlement Agreements with the Settling Defendants. Any class member who wishes to receive its share of the partial settlements must submit a Claim Form by February 13, 2017. A fairness hearing to approve the Settlement Agreements is scheduled to be heard on March 2, 2017.

You are a settlement class member if you are a person in the United States that purchased Capacitors (including through controlled subsidiaries, agents, affiliates or joint-ventures) from January 1, 2002 through July 22, 2015 (the “Class”). Excluded from the Class are the Defendants and governmental entities, the judges and chambers staff in this case, as well as any members of their immediate families.
