Joseph Saveri Law Firm - 2021 Antitrust Annual Report

Written by Dan VanDeMortel | 09.27.2022

The Joseph Saveri Law Firm and one of its landmark cases have been highly ranked in an antitrust report issued by The Huntington National Bank (HNB) and the Center for Litigation and Courts at UC Hastings College of the Law (Hastings).

The HNB/Hastings 2021 Antitrust Annual Report: Class Action Filings in Federal Court, surveying the national antitrust field from 2009 through 2021, recognized the firm as one of the "Top 25 Lead Counsel in Class Recovery" and among the top 20 in "Cases With Settlements Reaching Final Approval in 2021." One of the firm’s most impactful cases, In re Capacitors Antitrust Litigation, in which it is Court-appointed Sole Lead Counsel, was also ranked among the "Top 50 Cases With Settlements Reaching Final Approval 2009-2021." (Additional settlements reached at the case’s December 2021 trial and not included in the report’s calculations are awaiting final Court approval.)

This marks the third consecutive year the report has favorably ranked the firm. Previous editions were compiled by HNB and the University of San Francisco School of Law.

The 2021 report provides empirical analyses of antitrust class actions litigated in federal court from 2009 through 2021. It addresses the number of antitrust class action complaints filed each year, the average time to reach a settlement, the mean and median recoveries, the attorneys' fees and costs awarded, the total settlement amounts in each year, the law firms that represented plaintiffs and defendants in antitrust class action settlements, and related information.

The report also distinguishes private antitrust enforcement by industry, by type of claim (conspiracy claims (under Section 1 of the Sherman Act) as opposed to claims based on unilateral conduct (Section 2 of the Sherman Act)), and by type of plaintiff (whether claims were brought on behalf of direct or indirect purchasers).

Like previous reports, the 2021 edition relies largely on data for private U.S. antitrust class actions available through Lex Machina, as well as supplemental data analysis. By extending the dataset to 2009-2021, the report allows for a deeper analysis of private enforcement trends and their implications. It highlights the importance of private antitrust enforcement in the U.S. system and the important role played by antitrust class actions.

Huntington National Bank’s National Settlement Team provides one of the leading settlement account programs in the country. It has handled more than 3,500 settlements for law firms, claims administrators, and regulatory agencies. These cases represent over $65 billion, with more than 165 million checks.

The nonpartisan Center for Litigation and Courts was established in 2021 to expand the knowledge of civil litigation, alternative dispute resolution, and the courts; to distribute that knowledge to the bench, bar, legal academy, and public; and to supply resources and guidance to members of the UC Hastings law community interested in civil litigation. Hastings was established in 1878 as the original law department of the University of California in the heart of San Francisco.
