# NEC Tokin to Plead Guilty to Criminal Price Fixing

On September 2, 2015, the Department of Justice filed a criminal information against NEC Tokin Corporation in the U.S. District Court of the Northern District of California in San Francisco, alleging its violation of Sherman Act Section 1 for fixing prices on electrolytic capacitors. NEC Tokin has agreed to plead guilty and pay a $13.8 million criminal fine for conspiring with competitors between 2002 and 2013 to fix prices for capacitors sold to customers in the United States and elsewhere.

The Joseph Saveri Law Firm named NEC Tokin as a defendant in the civil action *In re Capacitors Antitrust Litigation* (N.D. Cal. Case. No. 4:14-cv-03264-JD) in which Mr. Saveri serves as Interim Class Counsel for the Direct Purchaser Plaintiffs.
